At the Second International Congress on Law and Applied Technology (Universidad Austral), an elegant synthesis circulated: tokenization and artificial intelligence converge on the same market, each mutating a different side of the equation. It's a technically accurate reading and, as formulated, an incomplete one. It's worth developing until it stops being descriptive and becomes a governance question.
Two Mutations Over the Same Market
Tokenization mutates the object of the market: the asset — a property, a right, a future income stream — is represented, transmitted, or transferred digitally, divisible and traceable in its movement. Artificial intelligence mutates the subject of the market: the agent that evaluates, decides, and acts does so with growing autonomy, with less direct human intervention at each step of the transaction.
Described separately, both mutations have already been the subject of extensive regulatory analysis. What the congress's synthesis captures, correctly, is that they no longer operate separately: an AI agent transacting directly on a tokenized asset isn't the sum of two parallel phenomena — it's a third phenomenon emerging at the point where both touch.
The formulation records that object and subject converge, but not for whom they converge. It's a structural omission, not a minor detail: when an AI agent operates directly on a tokenized asset, two questions of ownership and reciprocity remain completely open.
The first: who owns the data that made that mutation of the object possible — the transaction history, the origin traceability, the information that gave the asset value before it was tokenized. The second: who receives reciprocity when the AI agent — ultimately trained on data generated by people — operates and generates value over that tokenized object, without whoever originated that data participating in any way in the value generated.
Neither question is new in the abstract — they are, in essence, the same tension running through the whole discussion about AI models trained on third-party data. What changes in this scenario is that the tension is no longer distant or diffuse: it occurs at the exact, localizable moment of a transaction on a tokenized asset, which makes it, for the first time, technically auditable.
El giro necesario: de descriptivo a normativoThe Necessary Turn: From Descriptive to Normative
The right question in the face of this convergence isn't whether it works — it evidently works, the market already operates this way in early instances — but whether it's sovereign. It's an axis shift: from a compliance logic (preventing the convergence from resulting in precarization or non-consensual extraction) to a property-architecture logic, where the double mutation doesn't happen over the data producer, but with them as an active party on both sides of the equation.
Four technological pieces already exist to sustain that architecture, though today they mostly operate separately: blockchain provides verifiable decentralization; AI provides decision efficiency; smart contracts can encode automatic reciprocity at the exact moment of the transaction; tokenization distributes benefits programmatically among defined parties. What's missing isn't a fifth, more advanced technology — it's the deliberate combination of these four toward that explicit goal, something that doesn't happen by default in any market implementation that exists today.
Applied to the original scene: the exact moment of convergence — an AI agent operating on a tokenized object — is also the exact moment when a smart contract should encode automatic reciprocity toward whoever generated the data that made that operation possible. Not as an audit layer added afterward, reviewing what already happened, but as a condition of the transaction itself: without that encoding, the operation doesn't execute.
Dónde entra la supervisión escéptica sustantivaWhere Substantive Skeptical Oversight Comes In
The question substantive skeptical oversight raises about this convergence isn't one of market efficiency — it's forensic: is there an auditable record — hash, chained timestamp, evidence verifiable by a third party — of the exact instant when the algorithmic subject and the tokenized object meet? It's, in essence, the same problem already addressed for the oracles feeding external data into AI systems — the question of what source informed a decision and whether that source is verifiable — now applied not to the system's prior inputs, but to the point of convergence itself, where the decision becomes a transaction.
Without that specific traceability of the meeting point, the convergence between tokenization and AI is, from the outside, indistinguishable from value extraction with no record. The difference between the two isn't in the technology used — both can use exactly the same technical stack — but in whether or not there's a record that allows, afterward, reconstructing who generated the data, who used it, and whether reciprocity was encoded at the moment value was generated over it.
Tokenization and AI converging on the same market isn't, by itself, a problem — it's simply the direction infrastructure across several sectors is already moving. The problem appears when that convergence is designed without asking, from the outset, for whom it converges and under what conditions of traceability. The architecture that answers that question already exists in scattered pieces. What's missing is the decision to assemble them with that explicit goal, before the convergence generalizes without it.
