Las cuatro capasThe Four Layers
- Controles internos: vigilan riesgos de ciberseguridad, bioseguridad y amenazas químicas, y protegen contra hackeos.
- Equipo interno de verificación: revisa que esos controles funcionen de verdad.
- Auditor externo independiente: una mirada de afuera, sin vínculo con la empresa.
- Comité de directorio independiente: supervisa desde arriba, separado de quien opera el sistema.
- Internal controls: they watch for cybersecurity, biosecurity, and chemical-threat risks, and guard against hacking.
- Internal verification team: checks that those controls actually work.
- Independent external auditor: an outside look, with no ties to the company.
- Independent board committee: oversees from the top, separate from whoever runs the system.
Por qué autorregulación, y por qué ahoraWhy Self-Regulation, and Why Now
Estados Unidos compite con China por el liderazgo en IA y no quiere frenar esa carrera con una ley federal estricta. Por eso Trump prefiere la "autorregulación" (NBC News, 29/09/2026). Al mismo tiempo, las seis empresas con más interés en que no exista ningún límite son las que piden, ellas mismas, un límite auditado.
The U.S. is competing with China for AI leadership and doesn't want to slow that race down with a strict federal law. That's why Trump prefers "self-regulation" (NBC News, 09/29/2026). At the same time, the six companies with the biggest interest in having no limits at all are the ones asking for an audited limit.
No es una contradicción: un compromiso voluntario con auditoría externa es más barato y más rápido de armar que esperar una ley, y funciona como una defensa anticipada. Es el mismo cálculo que hace cualquier organización que adopta IA sin esperar a que el regulador se lo exija — la misma idea detrás del Sistema TRIA (Lento, 2026a), que llevamos a SIGEN a través de la Res. 197/2026.
It's not a contradiction: a voluntary commitment with external audits is cheaper and faster to set up than waiting for a law, and it works as early cover. It's the same bet any organization makes when it adopts AI without waiting for a regulator to force it — the same idea behind the TRIA System (Lento, 2026a), which we brought to SIGEN through Resolution 197/2026.

El Acuerdo no menciona a TRIA ni fue pensado para auditoría profesional, contable o tributaria. Sus cuatro capas no son lo mismo que los cuatro componentes de TRIA (Trazabilidad, Razonamiento, Inteligencia Artificial, Auditoría): son estructuras distintas, para problemas distintos, a escalas distintas.
The Accord doesn't mention TRIA, and it wasn't designed for professional, accounting, or tax audits. Its four layers aren't the same as TRIA's four components (Traceability, Reasoning, Artificial Intelligence, Audit): these are different structures, built for different problems, at different scales.
Lo que sí queda confirmado es la idea de fondo: ni el Estado ni quien construye el sistema confía en el control puramente interno. Registro verificable, revisión humana independiente y auditoría externa: es la misma estructura de tres pasos que planteamos en el primer paper de ERREPAR (Gavilán et al., 2026a), y que convertimos en herramienta concreta en MDMA-TRIA (Lento, 2026b): la Ventana de Control.
What is confirmed is the underlying idea: neither the government nor the company that builds the system trusts purely internal control. Verifiable records, independent human review, and external audit — that's the same three-step structure we laid out in the first ERREPAR paper (Gavilán et al., 2026a), and turned into a concrete tool in MDMA-TRIA (Lento, 2026b): the Control Window.

In other words: what's being negotiated today between the White House and the big AI labs already has a name at the scale of a company, a public agency, or a regulated profession.
El camino para ArgentinaThe Path for Argentina
Argentina todavía no tiene una ley nacional de IA. En 2025 se presentaron 53 proyectos sobre IA en el Congreso; 11 proponen una ley integral (6 en el Senado, 5 en Diputados), y ninguno avanzó (El Auditor, 2025). El más completo, del senador Martín Doñate, propone crear la Agencia Nacional de Supervisión de la IA (ANSIA), con trazabilidad y supervisión humana como principios centrales.
Argentina still doesn't have a national AI law. In 2025, 53 AI-related bills were introduced in Congress; 11 propose a full law (6 in the Senate, 5 in the Chamber of Deputies), and none has moved forward (El Auditor, 2025). The most complete one, from Senator Martín Doñate, proposes creating a National AI Oversight Agency (ANSIA), with traceability and human oversight as core principles.
Mientras el Congreso no avanza, las provincias ya se movieron dos veces en 2026: Buenos Aires aprobó el Decreto 961/2026 (gobernanza de datos, con un responsable de datos y una evaluación de impacto previa) y el Decreto 742/2026 (uso de IA en la administración pública), que exige trazabilidad humana obligatoria: registros auditables, intervención humana documentada y revisión de resultados antes de automatizar cualquier proceso.
While Congress stalls, the provinces have already moved twice in 2026: Buenos Aires passed Decree 961/2026 (data governance, with a data officer and a prior impact assessment) and Decree 742/2026 (use of AI in public administration), which requires mandatory human traceability: auditable logs, documented human involvement, and review of results before automating any process.

El vocabulario ya es el mismo en las cuatro filas: trazabilidad, supervisión humana, auditoría. Lo que falta en todas es una herramienta concreta que lo convierta en un procedimiento verificable, con estándar y puntaje, que un profesional matriculado pueda aplicar antes de que exista una ley que lo exija — no después, como defensa. Ese es el espacio que ocupa MDMA-TRIA, que venimos construyendo nota a nota en RePro (Balbi et al., 2026, nota 1181) y en la saga de ERREPAR.
The vocabulary is already the same in all four rows: traceability, human oversight, audit. What's missing in all of them is a concrete tool that turns this into a verifiable process, with a standard and a score, that a licensed professional can apply before a law requires it — not afterward, as a defense. That's the space MDMA-TRIA fills, which we've been building step by step in RePro (Balbi et al., 2026, note 1181) and in the ERREPAR series.
